WILLS AND ESTATES

Estate planning may be difficult, but looking ahead to how you would like your affairs to be handled in the event of an accident illness, injury or death is one of the most responsible things you can do.

Powers of Attorney are documents which delegate responsibility over your affairs to a designated person(s) in the event that you should suffer an accident, illness or injury which, though leaving you alive, result in your being unable to manage your interests.

Powers of Attorney are generally of 2 types:

  • A Power of Attorney for Personal Care: which deals with how you wish to be cared for and treated; and
  • A Power of Attorney for Property: which directs a specified individual to manage your assets and financial affairs.

A Will is a document which directs how you wish your affairs to be handled and your possessions to be distributed after your death.

Estate Administration is the area of law which deals with administering your Estate according to the terms of your will. That can entail gathering in your assets, paying your liabilities, managing your assets and distributing your possessions to the beneficiaries named in your Will. Estate Administration can also include the process of applying for and obtaining of a Certificate of Appointment of Estate Trustee With a Will which confirms the appointment of your Estate Trustee (Executor / Executrix) and validates your Will.
